A Taster of Law Summer Course Topics
Adverse Possession: Redistribution or Theft?
Property rights are among the most fiercely protected in many legal systems. Yet what should we do with apparently abandoned land? Adverse possession (often referred to more informally as squatter’s rights’), has long been recognised as a means by which people can acquire these highly valuable rights to land simply by living there for enough time without complaint from the legal owner. Yet many jurisdictions are now limiting the extent to which this applies, making it harder to transfer title to land this way. Who should policy makers prioritise - the owner on paper, or the inhabitant in practice?
Specific Performance: Exceptional Remedy or Expected Procedure?
Contracts are entered into on the assumption that people can rely on the other party doing what they promised. But what should the remedy be when they refuse to do so? Should it be possible to force people into following through on their agreement, or are damages sufficient? Different jurisdictions have different approaches to this question. If it is more economically efficient for a party to breach a contract than to perform it, does this override their moral responsibility to deliver? Through spirited discussions and critical analysis, you'll develop the skills and insights necessary to engage confidently in Oxbridge-style interview discussions, setting you apart as a law applicant.
Childhood: A Cocoon or a Cage?
Should a teenager be able to refuse lifesaving treatment? In medical law, adults benefit from a presumption of competence when it comes to decision making. As such, unless a doctor can prove they are not competent to make such decisions, to perform a medical intervention without their consent would be an offence. For minors, however, the opposite is true. Moreover in many jurisdictions, adolescents cannot refuse lifesaving treatment no matter how competent they may seem. This area is particularly interesting as arguments intersect with a range of fields, including philosophy and psychology.
Tribunal of Fact Vs Tribunal of Law
In the UK, the Crown Court has a unique structure where the judge is the tribunal of law and the jury is the tribunal of fact. This means that the decision of whether a defendant is guilty or not guilty is ultimately in the hands of 12 ordinary citizens-it could even be even you one day. In this session, we will consider the advantages and disadvantages of a jury trial, as well as the approach in different legal systems. Exploring topics like the dynamics of the Crown Court's judge-jury structure will strengthen your university application for law. By delving into the advantages and disadvantages of jury trials and examining varying legal systems' approaches, you'll cultivate a nuanced understanding of the legal process.
Supreme Court: Is it Time For It to Go?
As the highest court of the land, the Supreme Court has been criticised for displaying excessive judicial activism and departing from the interpretation of legislation that Parliament had intended. In this session we will discuss the role of the Supreme Court in the legal system, and if we were ever to abolish the Supreme Court, what would replace it. By critically analysing the role of the Supreme Court and exploring alternative scenarios, you'll demonstrate your aptitude for discussing complex legal issues and your commitment to shaping the future of the legal system through your studies.
Can a Life Sentence Ever Be Justified With the Notion of Rehabilitation?
Building a rehabilitative culture into prison is important for those offenders that will be released into society, but how does this notion of rehabilitation interact with offenders that receive life sentences? In this session, we will look at the potential objectives of custody and whether a life sentence can ever really be justified within a criminal justice system of which rehabilitation is the fundamental core. Delving into thought-provoking questions like the justification of life sentences through rehabilitation will significantly enhance your university application for law, showcasing your ability to engage in ethical debates and developing your understanding of the complexities of criminal justice.
